These Terms and Conditions govern the provision of swimming lessons and related services by Next Stroke Swim School. By booking or attending any of our classes, you (the parent, legal guardian, or adult participant) agree to be bound by these Terms and Conditions.
1. Bookings and Enrolment
- All bookings must be made through our booking form.
- Places in classes are subject to availability and are confirmed only once full payment (or agreed deposit) has been received.
- We reserve the right to refuse or cancel a booking if we believe it is not in the best interests of the swimmer, coach, or class group.
- It is your responsibility to ensure that all personal and contact information provided during booking is accurate and kept up to date.
- One-off group lesson bookings are limited to a maximum of one lesson per swimmer within any four (4) week cycle. We reserve the right to amend or withdraw this allowance at our discretion.
- When booking multiple lessons or block sessions, full payment for the entire course duration is required at the time of booking. As places are reserved for the full duration of the course, we are unable to fill individual sessions if a swimmer does not attend. For this reason, sessions within a block are non-refundable.
2. Fees and Payment
- Lesson fees will be communicated at the time of booking and may be charged per term, month, course block, or individual session, as stated in the booking information.
- All fees must be paid in advance by the due date specified. We reserve the right to refuse entry to lessons where payment has not been received.
- We may review and update our prices from time to time. Any changes will be communicated in advance and will not affect bookings already paid for.
- We do not offer refunds or credits for lessons missed due to holidays, illness, or other personal commitments.
3. Cancellations, Refunds and Credits
- Customer cancellations: If you wish to cancel a block booking before it starts, you must notify us in writing (email) within the timeframe specified in your booking confirmation. Any refund or credit will be at our discretion and may be subject to an administration fee.
- Once a course or term has started, fees are generally non-refundable and non-transferable.
- Missed lessons: We are under no obligation to provide refunds, replacements, or catch-up sessions for lessons you do not attend, whatever the reason.
- Our cancellations: In the event we need to cancel a lesson (for example, due to pool closure, instructor illness, or safety concerns), we will endeavour to offer either a replacement session, a credit, or a refund for the affected class.
4. Medical Conditions and Fitness to Swim
- You must inform us at the time of booking, and update us as necessary, of any medical condition, disability, injury, or additional needs that may affect the swimmer’s participation.
- If you are unsure whether a swimmer is fit to participate, you should seek advice from a medical professional before attending.
- We reserve the right to refuse participation or request medical clearance if we have concerns about a swimmer’s health or safety.
- Swimmers must not attend lessons if they are unwell, have a contagious condition (including but not limited to sickness and diarrhoea within the last 48 hours, ear infection, conjunctivitis, or open wounds), or any condition that may pose a risk to themselves or others.
5. Supervision and Responsibility for Children
- All children remain the responsibility of their parent or legal guardian at all times, except when in the care of the instructor during the lesson itself.
- A responsible adult must remain on the premises (or at a location stated by us) for the duration of each lesson for all under-16 swimmers.
- Parents/guardians are responsible for ensuring children follow pool rules and behave safely and respectfully in changing areas, poolside, and other facilities.
- We are not responsible for any child left unattended before or after their lesson.
6. Behaviour, Safety and Pool Rules
- All swimmers and accompanying adults must follow the instructions of our staff and pool staff at all times.
- Running, pushing, diving (where not permitted), and any form of dangerous behaviour is strictly prohibited.
- Appropriate swimwear must be worn. For young children and those not fully toilet-trained, approved swim nappies are required.
- Jewellery (other than small stud earrings) should be removed before lessons for safety reasons.
- Food, chewing gum, and glass containers are not permitted poolside.
- We reserve the right to remove from the pool or premises anyone whose behaviour we consider unsafe, disruptive, abusive, or otherwise unacceptable, without refund.
7. Parent and Baby / Parent and Child Classes
- In parent and baby/parent and child sessions, the responsible adult must accompany the child in the water for the full duration of the lesson.
- The responsible adult is expected to follow the teacher’s instructions and support their child’s participation safely.
- Each child must be accompanied by an adult who is physically able and confident in the water.
8. SEND and Additional Needs
- We aim to be as inclusive as possible and offer lessons for swimmers with Special Educational Needs and Disabilities (SEND) and additional support requirements.
- It is essential that you provide full and accurate information about the swimmer’s needs so we can assess suitability and make reasonable adjustments where possible.
- We may recommend a particular class type (for example, smaller group or 1:1 sessions) where this is more appropriate for the swimmer’s safety and progress.
9. Adult Lessons
- Adults participating in lessons are responsible for ensuring they are medically fit to swim and should seek medical advice if in any doubt.
- All adult swimmers must follow pool rules, instructor guidance, and behave in a respectful manner towards staff and other swimmers.
10. Pool Closures and Changes to Timetable
- Occasionally, pools may close or lesson times may need to change due to maintenance, technical issues, staffing, or other circumstances beyond our control.
- We will provide as much notice as reasonably possible and will offer an alternative session, credit, or refund for any cancelled lesson.
- We reserve the right to change class times, instructors, or locations. Where this results in a significant change, we will notify you and discuss suitable options.
11. Progress, Awards and Class Placement
- We will use our professional judgement to place swimmers in classes appropriate to their age, ability, and confidence.
- Progress can vary between individuals; we do not guarantee that a swimmer will achieve a particular award, level, or standard within a specific time.
- We may recommend moving a swimmer to a different group or level to support their development and safety.
12. Personal Property
- All personal belongings are brought to lessons at your own risk.
- We do not accept responsibility for the loss of, or damage to, any property whilst on the premises, including in changing rooms, lockers, or poolside.
13. Photography, Video and Social Media
- For child protection and privacy reasons, photography and video recording are generally not permitted during lessons or on poolside unless explicitly authorised by us and the pool.
- From time to time, we may arrange for photographs or video to be taken for training, safety, or promotional purposes. In such cases, we will provide advance notice and, where required, seek consent in accordance with our safeguarding and data protection policies.
- Images of swimmers will never be shared by us in a way that identifies them by full name without explicit consent from the parent/guardian or adult swimmer.
14. Data Protection and Privacy
- We collect and process personal data only as necessary to provide our services, manage bookings, ensure safety, and meet legal obligations.
- We will store your data securely and will not share it with third parties.

15. Liability
- We will provide our services with reasonable care and skill and in accordance with relevant industry standards.
- Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
- Subject to the above, we will not be liable for any indirect or consequential loss, or for any loss of property, income, or profit arising out of or in connection with attendance at our lessons.
- You are responsible for your own safety and that of any children in your care when not under the direct supervision of our instructors during the lesson.
16. Safeguarding
- We are committed to safeguarding and promoting the welfare of children and vulnerable adults.
- All concerns regarding welfare or safety should be reported immediately to a member of staff so that appropriate action can be taken.
17. Complaints
- If you have a concern or complaint, please raise it with us as soon as possible so that we can try to resolve the matter promptly.

- We will investigate all complaints fairly and respond within a reasonable timeframe.
18. Changes to These Terms and Conditions
- We may update these Terms and Conditions from time to time. The latest version will be published on our website and will apply to all new and ongoing bookings.
- Where changes are significant, we will use reasonable efforts to notify existing customers.
19. Governing Law
- These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
